The efforts to protect parents and families continue on many fronts. 

Bills are being filed to protect families and children in public schools from indoctrination and to give parents more power against those who view schools as superior to parents when it comes to raising children.

We are fully engaged in those debates and are following and participating in the development of legislation that addresses those and other issues related to empowering parents.

We will continue to report on those issues as they develop during the legislative process. We also work hard to defend our innocent families from investigations by Child Protective Services (CPS).

While our THSC team usually has one or two cases per month, in the last two months of 2022, we had 17 families that we helped. 

We utilized not only our family advocates but the legal team and our relationship with the agency itself, as we sometimes deal with caseworkers who do not follow the agency guidelines or the law.

We are also working in the courts to defend parental rights as well. The Supreme Court of Texas (SCOTX) recently issued a decision regarding litigation in which a former in-law was arguing that a father was not “fit” because he had once been investigated by CPS even though he had been exonerated and his children were returned. This non-parent was seeking custody of his children using that flimsy legal argument, and SCOTX denied her case leaving in place the current protections for parents.

Legal experts say that the court likely denied her appeal because the in-law waited until the final moment of the case to claim that she had overcome the presumption in the father’s favor but that at every prior point in the case, she had contended that the presumption did not apply in the first place.

Our position is simple: courts may not overrule the decisions of a parent regarding their children unless it is necessary to protect the child from significant harm. 

This case was a major win for parental rights because Treigh Kalinec’s rights as a father were upheld.

Because the Supreme Court did not take up the case, FFP will continue looking for future opportunities to make the argument to the court that parental rights should never be overruled except to prevent significant harm. A ruling on that issue from the Supreme Court of Texas will be essential for the long-term protection of parental rights in Texas.

Tim Lambert, has been the president of the Texas Home School Coalition since 1990 and involved in homeschool leadership since 1984. He and his wife Lyndsay taught their four now-grown children at home for 16 years, graduating the last two in 2000. As the head of the organization for the leading home school state in the country, he is recognized as an authority on home education issues.

Tim has testified before numerous Texas legislative committees on issues related to homeschooling and often deals with state government agencies, including the Texas Education Agency and the Texas Department of Family and Protective Services. He has also addressed such conferences as the Texas Association of Collegiate Registrars and Admissions Officers on the topic. He holds a B.A. in political science from Texas Tech University and is active in the political arena, serving eight years as Republican National Committeeman for Texas. Tim is committed to serving the homeschooling community and to protecting parents’ right to choose the method of education of their children.
