For Immediate Release: Rep. Cook Files HB 2674 to Protect Texas Homeschool Families from State Regulation
AUSTIN, TX — State Representative David Cook has officially filed House Bill 2674, a legislative measure designed to safeguard homeschool families from regulation by state agencies. The bill ensures that neither the Texas Education Agency (TEA) nor the State Board of Education (SBOE) can impose new restrictions on homeschooling without explicit legislative approval.
Currently, the TEA states that it “does not regulate, index, monitor, approve, register, or accredit the programs available to parents who choose to home school.” HB 2674 reinforces this principle and enshrines it into law, preventing executive agencies from overstepping their authority in a way that could threaten homeschool freedom.
“This bill ensures that new regulation on homeschooling is not unilaterally adopted by executive agencies,” said Jeremy Newman, Vice President of Policy at the Texas Home School Coalition “In the 1980s and 1990s, the TEA and the SBOE decided unilaterally to make homeschooling illegal, even though the Texas legislature had made it legal in 1915. Parents were prosecuted, thrown in jail, and had their children removed by CPS because of their decision to homeschool. After a 9-year court battle, the SCOTX ruled unanimously in the landmark Leeper v. Arlington ISD that homeschooling was legal. This bill ensures that we never again have a situation where an executive agency tries to unilaterally regulate homeschool programs.”
For more than 20 years, states across the country have successfully held the line against increased regulation on homeschoolers and have repeatedly defeated such bills in state legislatures. HB 2674 was filed to ensure that homeschool freedom in Texas remains protected for generations to come.
The Texas Home School Coalition (THSC) strongly supports this legislation and is encouraging lawmakers to stand with Texas families in defending their right to direct their children’s education free from government overreach.
