Equal Treatment for Homeschoolers in College

This bill, filed by Representative Paul in the House (HB 3041) and Senator Middleton in the Senate ( SB 1716), helps students from nontraditional backgrounds, like homeschoolers. This bill ensures that homeschool students are treated equally when it comes to accessing financial aid, having class rank calculated fairly, and participating in dual credit programs.

  • As of June 20, 2025, HB 3041 has been signed by Governor Greg Abbott and went into effect immediately.

Homeschool Freedom Act

State Representative David Cook filed House Bill 2674, a legislative measure designed to safeguard homeschool families from regulation by state agencies. The bill ensures that neither the Texas Education Agency (TEA) nor the State Board of Education (SBOE) can impose new restrictions on homeschooling without explicit legislative approval.

  • As of June 20, 2025, HB 2674 has been signed by Governor Greg Abbott and will go into effect on September 1, 2025.

UIL Equal Access Expansion

This bill, filed by Senator Paxton in the Senate (SB 401) and filed by Representative Frank in the House (HB 775), focuses on expanding opportunities for homeschool students in Texas to participate in University Interscholastic League activities at their local public school. In 2021, this program launched, but so far only about 40 school districts in Texas have participated. Under this new bill, all school districts will participate by default and it will require a vote of the school board to opt-out of the program. Students whose school districts opt-out will be allowed to participate at the next closest district.

  • As of June 20, 2025, SB 401 has been signed by Governor Greg Abbott and went into effect immediately.

Homeschool Constitutional Amendment

SJR 12, filed by Senator Paxton, places protections directly into the Texas Constitution prohibiting the state from regulating homeschools and private schools, ensuring that educational freedom is protected for generations to come.

  • On April 7, 2025, SJR 12 passed out of the Senate with 21 yeas and 9 nays, and was referred to the House Committee on Public Education on April 17, 2025. SJR 12 did not advance further before the session ended on June 2, 2025.

Other Important Bills for Homeschoolers

School/Parental Choice Legislation: Parental choice (also known as School Choice) programs are programs that allow funding for students to follow them to other forms of education besides just public school. Parents would then be allowed to use those funds for private education. This item has been a major point of discussion in Texas and it is a top priority of Governor Greg Abbott, Lt. Gov. Dan Patrick, and Speaker of the House Dustin Burrows. There is a high probability of the bill passing. THSC has been closely involved in these discussions to ensure three primary things:

  • The protection of homeschoolers who choose not to participate, ensuring they will be completely untouched by the programs.
  • The inclusion of strong language that protects families who do choose to participate in these programs from state interference in their education.
  • That the programs work for homeschool families that choose to participate, including expenditures they can actually use (e.g. dual credit, tutoring/therapy, books/curriculum, educational supplies, tests, etc.
