Parental Rights Are a Supreme Court Issue... Again

In 2020, THSC launched a campaign to bring to the attention of the public a court case in which a judge gave a man who was not related - either by blood or by marriage - joint custody of a 4-year-old child against the wishes of a fit father. Thankfully, the Supreme Court of Texas (SCOTX) rendered a unanimous decision overturning that travesty and clarifying that when a fit parent (defined as a parent that provides for the needs of the child and is not abusive or neglectful), is being challenged in court by a non-parent, the court must presume that decisions the parent makes for the child is in his best interest. In other words, the judge does not get to make the decision about what he believes would be the best for the child unless the parent is not a fit parent. However, SCOTX did not decide what standard would be required to determine that a parent was not a fit parent. There is now a case before SCOTX in which a grandparent is asserting that since a parent had a child temporarily removed by CPS, the parent should be considered unfit. This is in spite of the fact that the parent was found innocent of the charges leveled against him and his child returned. This is a critical case because if a parent is determined to be unfit simply because of an accusation made against them to CPS, it would all but gut the decision made by the court last year. Please pray for the court in this case to make the right decision and uphold the God given right of parents to raise their children as they see fit. THSC will be following this case and likely filing a brief in the case in support of the parents should the court decide to take the case. THSC believes that fit parents should be free from attacks on their character and their good intentions for their children. Is child abuse on the rise as homeschooling numbers go up?

Last summer as the whole country was in the midst of an explosion of homeschooling, Harvard University was attacking homeschooling as dangerous for children and calling for laws that would “presumptively ban” the practice. They even made the unfounded argument that child abuse would increase as children were at home instead of in school! I wrote then, “This position is so lacking in documentation that it has been roundly disparaged across the political spectrum.” In response to the anti-homeschooling Harvard professor, Dr. Peter Gray wrote in Psychology Today: “On the basis of available evidence, it is absurd to believe that the total amount of hurt done to children would go down rather than up if homeschooling were outlawed.” Recently the Associated Press reported that officials at the U.S. Department of Health and Human Services say that this forecast of increased child abuse by parents did not happen. All the predictions that child abuse would rise as homeschooling numbers were on the rise proved to be incorrect. The AP says officials explained, “The report showed that the number of children determined to be victims of abuse and neglect fell for the first time in five years, dropping more than 3%. In 2019, 656,000 children were maltreated, down from 677,000 in 2018, the report said.” So instead of the increase in child abuse that the “experts” at Harvard predicted there appears to be a major drop for the first time in five years! I’m still waiting for the Harvard law professor to acknowledge this. I couldn’t agree more with the HHS official who said in June of 2020, “To sound alarm bells, because teachers aren’t seeing kids every day, that parents are waiting to harm their kids — it’s an unfair depiction of so many parents out there doing their best under very tough circumstances.” Despite uncalled for attacks on homeschooling itself and attacks on the competence of homeschooling parents, homeschooling continues to grow at record rates. The homeschool community will continue to stand strong and fight against those who try to take homeschooling freedom away from families. Teaching U.S. History in Light of the 1619 Project

In 2019, The New York Times launched a controversial new take on the history of the United States of America. It is called “The 1619 Project” and is self-described as an effort to “reframe the country’s history” by arguing that our country was founded upon the idea of slavery. According to The 1619 Project, that should be America's real inception date (instead of 1776) since 1619 was when the first slaves landed upon our shores. The Wall Street Journal wrote, “James McPherson, dean of Civil War historians and another Pulitzer winner, said the Times presented an ‘unbalanced, one-sided account’ that ‘left most of the history out.’ Even more surprising than the criticism from these generally liberal historians was where the interviews appeared: on the World Socialist Web Site, run by the Trotskyist Socialist Equality Party.” This effort to rewrite history has been opposed by many from both sides of the political spectrum as an attack on not only our country but upon the founding documents of the country, that is The Declaration of Independence and the Constitution. In response to this effort to “reframe” American history, President Trump commissioned a non-partisan group called the “1776 Commission” to recommend a balanced approach to restoring patriotic teaching of U.S. history. While President Biden has canceled the 1776 Commission, it has nevertheless released a report that would be of great interest to homeschoolers who are interested in giving a balanced view of our history. One of the members of the Commission, Victor Davis Hanson, said of the report, “Two of the most widely referenced Americans in the report are Frederick Douglas and Martin Luther King Jr. Both argued, a century apart, for the moral singularity of the U.S. Constitution. Neither wished to replace the founders' visions; both instead demanded that they be fully realized and enforced.” This is the kind of discussion that homeschool families should have which will lay a great foundation for the understanding of our country and its heritage. We believe in empowering parents to raise and educate their children, teaching them accurate accounts of history that haven’t been rewritten to suit our modern preferences.
